Terms of Service

Effective 14 September 2026

These Terms of Service (the Terms) govern access to and use of PeakTask, a business operations service provided by FirstArc Ltd, trading as PeakTask (PeakTask, we, us or our). By creating an account or using the service, you agree to these Terms.

1. Who these Terms apply to

PeakTask is provided for business use. In these Terms, Customer means the organisation that obtains access to PeakTask, and Authorised User means a person permitted by that Customer to use it.

You must be at least 18 years old to use PeakTask. If you accept these Terms for a Customer, you confirm that you have authority to bind it. The Customer is responsible for its Authorised Users and their compliance with these Terms.

If the Customer has a separate written agreement with us covering PeakTask, that agreement will prevail to the extent of any conflict with these Terms.

2. The service

PeakTask helps organisations plan, assign, update and retain records of operational tasks. We may improve, update or change the service from time to time, provided that we do not materially reduce paid functionality during an agreed paid term without a reasonable operational, legal or security reason.

PeakTask is an administrative tool. It does not provide legal, regulatory, employment, immigration, recruitment or other professional advice, and it does not replace the Customer's own checks, records or decisions.

3. Accounts and access

You must provide accurate account information, keep credentials confidential and use reasonable measures to prevent unauthorised access. Accounts may not be shared. Tell us promptly at [email protected] if you believe an account or the service has been compromised.

The Customer controls which Authorised Users may access its workspace and is responsible for promptly removing access when it is no longer required.

4. Customer Data and data protection

Customer Data means information submitted to the service by or for the Customer. The Customer retains its rights in Customer Data and gives us a worldwide, non-exclusive licence to host, copy, transmit and otherwise process it only as needed to provide, secure, maintain and support PeakTask, comply with law and enforce these Terms.

The Customer is responsible for the accuracy, quality and legality of Customer Data. It must have all rights, notices, lawful bases and consents needed to collect and use that data and to instruct us to process it. This includes personal information about workers, helpers, employees, runners and other individuals, such as identity, travel, health-related and address information. The Customer must only submit data that is necessary for its lawful use of PeakTask.

Each party will comply with the data protection laws that apply to it. Where we act as a processor for the Customer, we will process personal data on the Customer's documented instructions, ensure relevant personnel are bound by confidentiality and use appropriate technical and organisational safeguards. The Customer authorises us to use service providers as subprocessors where needed to operate PeakTask, subject to appropriate contractual protections.

5. Acceptable use

You must not, and must not allow anyone else to:

  • use PeakTask unlawfully or to infringe another person's rights;
  • access data or accounts without authorisation;
  • upload malware or harmful, deceptive or unlawful material;
  • interfere with, overload, probe or circumvent the service or its security;
  • copy, resell, scrape, reverse engineer or create derivative works from PeakTask, except where the law does not allow that restriction; or
  • use the service to develop or benchmark a competing product.

6. Our intellectual property

We and our licensors own PeakTask, including its software, design, branding and content. Subject to these Terms and any separate agreement, we grant the Customer a limited, non-exclusive, non-transferable and revocable right for its Authorised Users to use PeakTask for the Customer's internal business operations.

If you provide feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.

7. Third-party services

PeakTask may rely on or link to third-party services. We are not responsible for third-party services outside our control, and their own terms may apply. We remain responsible for our obligations under these Terms when using suppliers to provide PeakTask.

8. Fees

PeakTask costs S$29.99 per month on monthly billing or S$239.88 per year on annual billing. One subscription covers the Customer's organisation and its Authorised Users. A 14-day free trial begins when the organisation owner completes checkout with a valid payment method. Unless cancelled, the selected plan is charged when the trial ends and renews automatically each month or year until cancelled.

The organisation owner can change plans, update payment details, view invoices or cancel through the billing portal. Cancellation takes effect at the end of the current trial or paid billing period. Fees already paid are non-refundable except where required by law.

9. Availability and changes

We aim to keep PeakTask available and reliable, but we do not guarantee uninterrupted or error-free operation. We may suspend or limit access for maintenance, security, capacity, legal or operational reasons. Where reasonably practicable, we will give advance notice of planned material interruptions.

10. Suspension and termination

We may suspend access immediately where we reasonably believe there is a security risk, unlawful use, non-payment, a material breach of these Terms or a need to protect the service or others. Where the issue can be remedied, we will normally give the Customer a reasonable opportunity to do so.

Either party may end free access on reasonable notice. Paid access may be cancelled as set out in section 8 or any separate written agreement. Before access ends, the Customer should export any Customer Data it wishes to keep. After termination, we may delete Customer Data, subject to applicable law and reasonable backup-retention cycles.

Terms which by their nature should continue after termination, including those about intellectual property, confidentiality, liability and governing law, will survive.

11. Confidentiality

Each party will protect the other's non-public business, technical and commercial information using reasonable care and will use it only to perform or receive the service. This does not apply to information that is public through no breach, already lawfully known, independently developed or lawfully received from another source. A party may disclose confidential information where required by law and, where legally permitted, will give advance notice.

12. Warranties and disclaimers

We will provide PeakTask with reasonable care and skill. Except as expressly stated in these Terms, and to the fullest extent permitted by law, PeakTask is provided “as is” and “as available” and all implied warranties, conditions and other terms are excluded. We do not warrant that PeakTask will meet every Customer requirement or that information entered by users will be accurate or complete.

13. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Subject to the paragraph above, neither party will be liable for indirect or consequential loss, or for loss of profit, revenue, anticipated savings, goodwill or business opportunity. The Customer is responsible for maintaining copies of records it is legally or operationally required to retain.

Subject to the first paragraph of this section, each party's total aggregate liability arising out of or in connection with PeakTask or these Terms will not exceed the greater of £100 and the fees paid or payable by the Customer for PeakTask during the 12 months immediately before the event giving rise to the claim.

14. Customer indemnity

The Customer will indemnify FirstArc Ltd against third-party claims, losses and reasonable costs arising from Customer Data or the Customer's unlawful use of PeakTask, except to the extent caused by our breach of these Terms, negligence or wilful misconduct.

15. Changes to these Terms

We may update these Terms to reflect changes to PeakTask, our business or applicable law. We will post the updated Terms with a new effective date and give reasonable notice of material changes. Changes required for legal or security reasons may take effect sooner. Continued use after the changes take effect constitutes acceptance of the updated Terms.

16. General

Neither party is liable for delay or failure caused by events beyond its reasonable control. The Customer may not assign these Terms without our written consent; we may assign them as part of a reorganisation, financing or transfer of the relevant business. A failure to enforce a right is not a waiver. If any provision is unenforceable, the remaining provisions continue in effect. These Terms and any applicable written agreement are the entire agreement about their subject matter. No person other than the parties has a right to enforce these Terms.

17. Governing law and courts

These Terms and any non-contractual dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or PeakTask.

18. Contact and company information

Questions or notices about these Terms may be sent to [email protected].
